Peli Filip Competition team has a wide-ranging
experience in both antitrust and state aid matters.
During their previous engagements, our lawyers have assisted in some of the landmark competition cases in Romania, bringing a new vision, new arguments, a
new manner of working (e.g., side by side with reputed economists). These projects included:
- The first investigation in the pharmaceutical industry and the first investigation of an alleged abuse of
dominant position: assisting the largest Romanian
manufacturer of generic products accused of
having abused its position by ceasing to
manufacture medicines essential to the public
national healthcare system. - The first investigation in the telecommunications
industry: assisting one of the largest mobile
operators in relation to the alleged cartel between
the major mobile telecom players in Romania and
the national fixed telecom incumbent to
discriminate and refuse to deal with one of the
new entrants on the mobile telephony market. - The first investigation of an alleged collective
dominance: assisting one of the largest cement
producers in Romania in relation to the alleged
abuse of collective dominance and price cartel. - Phase II investigations and approvals of mergers: assisting one of the largest cement producers in Romania in its acquisition of the only Romanian stevedoring company for construction materials.
- Complex advices with respect to state aid matters
in connection to privatisation cases: acquisition of
an integrated oil & gas company (the largest
Romanian company) or assisting the Romanian
state in relation to the privatisation and sale of the
largest Romanian bank.
Our lawyers have also acted in matters such as i) the
structuring of transactions; ii) notifications of
transactions (whether merger control, vertical
agreements, cooperation agreements) and assistance
for obtaining approval from the Competition
Council; iii) competition audits to verify competition
law compliance; iv) competition and regulatory advice
in relation to the structuring of corporate policies
(pricing, marketing, sales, strategic development, etc); v) training for clients and their employees (management, sales force, marketing personnel, etc) on competition law in Romania and the European Union.
