PeliFilip assisted the European consortium Vinci-Aktor, the winner of the public procurement procedure for the construction and operation of the Comarnic-Brasov motorway, in relation to the first major infrastructure project in Romania to be implemented through a concession-based structure. With a value exceeding EUR 1.7 billion, this is the most important infrastructure project in recent years.
The transaction involved legal assistance in relation to a complex competitive dialogue public procurement procedure, as well as an extensive analysis of a wide range of legal aspects regarding the development, construction and operation of a motorway in Romania. For more than a year, PeliFilip together with Linklaters have provided legal assistance in relation to various matters on the project, including the preparation of the offer and the participation of the consortium to the competitive dialogue procedure and the negotiations for the finalization of the agreement.
“We believe that with this project we have created a precedent and that a new way in the infrastructure field in Romania has been opened. We hope that the success of this transaction will lead to other infrastructure projects based on concession structures being launched, as well as to an increase in the investments in infrastructure by both the State and the major companies in the field”, declared Francisc Peli, Partner at PeliFilip.
PeliFilip team that worked on the project was coordinated by Francisc Peli, Partner, head of the Infrastructure and Real Estate departments of the firm, and was composed of Alina Stancu Bîrsan, Senior Associate PeliFilip, Ioana Ene and Oana Bãdãrãu, Associates PeliFilip. Carmen Peli, Ioan Dumitrascu and Alexandru Bîrsan, Partners at PeliFilip, have also been involved in various stages of the project.
